O R D E R:
1. In the reference 2nd read above, the Accountant General has brought to notice of the government certain difficulties faced in the course of authorising family pension to the disabled children.
2. In the reference 3rd read above, Government issued guidelines for evaluation of various disabilities and procedure for certification. However, necessary amendment was not made to Rule 50 of APRPRs 1980 accordingly.
3. Government after careful examination of the matter family pensions to the disabled children it is proposed to issue necessary amendment to the existing provisions under Rule 50 of Andhra Pradesh Revised Pension Rules, 1980.

5. Accordingly, the following notification will be published in the Andhra Pradesh Gazette.
NOTIFICATION
In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Revised Pension Rules, 1980.
AMENDMENT
In Rule 50 of the said rules after sub-rule 5, the following shall be added namely:

The provision under Rule 50(5) (iii) of APRPRs 1980 is that the family pension shall be paid such son or daughter through the guardian as if he/she were a minor.

The provision under Rule 50(5)(iii) of APRPRs 1980 is that the family pension shall be paid to such son or daughter through the guardian as if he or she were minor except in the case of the physically crippled son or daughter who has attained the age of majority.

The provision under Rule 50 (5) (iv) of APRPRs 1980 is that before allowing the family pension for life to any such son or daughter, the sanctioning authority shall satisfy that the handicap is of such a nature as to prevent him or her from earning his or her livelihood and the same shall be evidenced by a certificate obtained from a medical officer not below the rank of Civil Surgeon setting out, as far as possible, the exact mental or physical condition of the child.

Rule 50(5)(iv) of APRPRs 1980 that the handicap is of such a nature so as to prevent him or her from earning his or her livelihood and the same shall be evidenced by a certificate obtained from a Medical Board.
The pension sanctioning authority has to endorse the earning capacity of claimant based on the certificate issued by the Medical Board while sanctioning the pension. |
The Executive instructions at para (v) under Rule 50 APRPRs 1980, is that ….. “The pensioner has to appoint a guardian to receive the family pension by such children”.

The Executive instructions at para (v) under Rule 50 of APRPRs 1980,…. In the case of a mentally retarded son or daughter, the family pension shall be payable to a person nominated as guardian by (a) the Government Servant, (b) Pensioner, (c) Spouse, (d) Certificate issued under Section 14 of the National Trust Act 1999 (No.44 of 1999) by local level committee shall be accepted and (e) As per orders of Court.

6. Therefore, all Pension Sanctioning Authorities are instructed to follow scrupulously the guidelines issued in G.O. Ms. No.31, WD, CW&DW (DW), dt. 1.12.2009 and verify the correctness of the certificate issued by the Medical Board duly certifying the earning capacity of claimants before forwarding the papers to Pension Authorising Authorities i.e. Accountant General/ State Audit. The appointment of guardian is at the option of the physically disabled children who attains majority. Therefore, the Pension Payment Officers are instructed to disburse the pension to the physically disabled children who has attained the age of majority without insisting Guardian.
